Assumption of Risk and Waiver of Liability Agreement

All attendees participating in CSBA’s 2026 Annual Education Conference and Trade Show (AEC)will be required to review and sign the Assumption of Risk and Waiver of Liability Agreement prior to participation.

To help attendees review the terms in advance, a copy of the waiver is available below for informational purposes only.

In consideration for the California School Board Association (“CSBA”) permitting me to attend the 2026 Annual Education Conference and Trade Show (“AEC”), I, the undersigned, on behalf of myself, and my heirs, executors, administrators, and assigns, hereby agree to the following terms and conditions of this Assumption of Risk and Waiver of Liability Agreement (“Waiver”):

    1. Voluntary Participation. I understand and recognize that my attendance at AEC, whether as an attendee, speaker, exhibitor, sponsor, or guest, and including all pre-conference and related activities, is strictly voluntary.
    2. Acknowledgement of Risk. I understand that attending AEC will involve participation in a variety of “Conference Activities,” including, without limitation, attendance at educational sessions, workshops, and presentations; participation in receptions, networking events, and meal functions; movement throughout conference facilities and exhibit areas; and interaction with other attendees, exhibitors, vendors, and staff. The Conference Activities may involve extended periods of standing, walking, lifting, or carrying, as well as exposure to outdoor conditions (including inclement weather) and indoor environments (including close proximity to groups of people in confined or crowded spaces). The Conference Activities may also include the use of hotel facilities and services, including guest rooms, meeting spaces, elevators, and common areas, as well as travel to, from, and between event locations by various means, including personal vehicles and organized or third-party transportation, such as shuttle services.The Conference Activities I may participate in involve risks that are inherent and cannot be reasonably avoided without changing the nature of the activities. Risks inherent in participating in the Conference Activities, include, but are not limited to, physical or psychological injury, illness (including exposure to COVID-19 or other contagious or infectious diseases), temporary or permanent disability, death, loss of income or career opportunities, and property damage, loss, or theft. Such risks may arise from travel to and from the conference, transportation by any means, lodging at the conference hotel or other accommodations, interactions with other attendees, exhibitors, vendors, or members of the public, participation in organized or informal activities, consumption of food or beverages, and exposure to unsafe conditions, accidents, or the acts or omissions of third parties.
    3. Assumption of Risk. I understand and acknowledge and expressly assume all responsibility for any such risks associated with participation in the Conference Activities. These risks include, but are not limited to, those identified above in this Waiver. I understand that these risks, injuries, or outcomes may arise from my own actions or inactions, the actions or inactions of others (including other attendees, exhibitors, vendors, and third parties), or the condition of the conference premises or any related locations. Nonetheless, I acknowledge and expressly assume all risks and dangers associated with all Conference Activities, whether described above, known or unknown, and inherent or otherwise. I take full responsibility for any injury or loss, including bodily injury, personal injury, emotional distress, property damage or death, which I may suffer, arising in whole or in part from my participation in the Conference Activities. I understand and assume these risks on behalf of myself, my heirs, executors, administrators, and assigns.
    4. Voluntary Release of All Claims. To the fullest extent permitted by law, I voluntarily release and discharge CSBA and its current and former officers, directors, employees, agents, contractors, and representatives (each, a “Released Party”) from any and all claims, demands, damages, losses, or liabilities of any kind, including, but not limited to, claims for personal injury, illness, emotional distress, property damage, economic loss, consequential damages, attorneys’ fees and costs, or wrongful death (collectively, “Claims”), arising out of or related to the Conference Activities or my attendance at AEC, including claims based on the ordinary negligence (whether active or passive) of any Released Party. This release does not apply to Claims arising from the gross negligence or willful misconduct of a Released Party.
    5. Voluntary Release from Third Party Liability. I understand that CSBA does not control and is not responsible for the acts or omissions of any third party, including, without limitation, sponsors, exhibitors, venues, hotels, transportation providers, or other vendors or service providers associated with the Conference Activities. Accordingly, I acknowledge and agree that CSBA is not liable for any loss, injury, damage, or delay caused by such third parties. To the fullest extent permitted by law, I, on behalf of myself and my heirs, executors, administrators, and assigns, voluntarily release, discharge, and waive all Claims arising out of or related to the acts or omissions of such third parties as against the Released Parties.
    6. Indemnification/Hold Harmless. To the fullest extent provided by law, I agree to defend and indemnify CSBA and hold any Released Party harmless from any and all Claims caused by my negligent, intentional, or other conduct related to or arising out of my actions while participating in the Conference Activities. Such indemnification obligation shall not extend to a Released Party if the Claim was caused by such Released Party’s gross negligence or willful misconduct.
    7. Entire Agreement. This Waiver constitutes a single, integrated contract expressing the entire agreement by myself and CSBA, regarding me assuming risks and waiving liability as to the 2026 AEC. There are no other agreements, written or oral, express or implied, between myself and CSBA concerning those subjects.

I agree that this waiver is intended to be as broad and inclusive as is permitted by the law in the State of California and that if any part of this waiver is deemed to be invalid, the remaining terms shall continue in full force and effect.

I HAVE READ THIS WAIVER AND FULLY UNDERSTAND ITS TERMS. MY ACKNOWLEDGEMENT IS VOLUNTARY AND INDICATES THAT I ACCEPT ALL TERMS OUTLINED IN THIS WAIVER.
